Terms of Service
These Terms of Service (the "Terms") are an agreement between you and Wiebelhaus Enterprises LLC, doing business as CreatorTrack.ai ("CreatorTrack", "we", "us"), governing your use of creatortrack.ai and app.creatortrack.ai (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service
CreatorTrack is a workspace for content creators and small businesses: tasks, projects, calendar, notes, goals, content research and planning, audience analytics, finances, CRM, and related tools, including optional connections to third-party services and optional AI features. CreatorTrack also provides permission-based audience, email, and public creator page tools, including optional custom domains, gated content, and media kits that visitors unlock by submitting an email address or other requested information. The Service is under active development; features may be added, changed, or removed. Some features are labeled preview or beta and may change or be withdrawn without notice.
2. Eligibility and accounts
- You must be at least 13 years old to use the Service.
- You are responsible for your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
- Information you provide must be accurate, and you may not impersonate another person or entity.
3. Your content
You retain all rights to the content you create in or import into the Service. You grant us a limited license to host, store, process, and display that content solely to operate and improve the Service for you and the people you share it with. We claim no ownership of your content. If you invite members to a workspace, you control what they can see and do through the permissions you set.
4. Connected services
You may connect third-party accounts such as Google (Calendar, Tasks, Contacts, Gmail, YouTube) or social platforms. By connecting an account you authorize CreatorTrack to access it on your behalf as described in our Privacy Policy, and you agree to comply with the third party's own terms. You can disconnect a service at any time; we are not responsible for the availability or accuracy of third-party services or data.
5. Acceptable use
You agree not to:
- Break the law or infringe the rights of others using the Service.
- Probe, disrupt, or breach the security or integrity of the Service.
- Access the Service by automated means other than documented APIs and integrations, or resell access without our written consent.
- Send spam or unlawful communications, use purchased, rented, scraped, harvested, or third-party recipient lists, or misrepresent how recipients joined your audience.
- Upload malware or content that is unlawful or harmful to minors.
- Publish content on a public creator page or custom domain that is unlawful, infringes someone else's rights, or that you don't have the right to share.
Email collection and sending are also governed by our Email Sending Policy. We may pause or terminate sending when an account creates unacceptable bounce, complaint, abuse, legal, or reputation risk.
If you believe content published through the Service infringes your rights, contact [email protected] with enough detail for us to locate and review it.
6. Public creator pages, custom domains, and lead capture
If you publish a public creator page, its content, including anything behind a gate or media kit, is visible to anyone who visits it or the URL you share. You are responsible for what you publish and for keeping any custom domain you connect registered and pointed correctly; we are not responsible for a domain that lapses or is misconfigured outside the Service.
When a visitor submits an email address or other information to unlock gated content on your page, that information is collected on your behalf and stored in your workspace. You are responsible for displaying an accurate disclosure, using the information only for the disclosed purpose, honoring unsubscribe and privacy requests, and complying with applicable law. CreatorTrack processes it to operate the feature for you.
7. Fees, billing, and AI credits
Core features may currently be offered free of charge. Paid plans, where offered, are billed through our payment processor, Stripe, and may auto-renew on a recurring schedule disclosed at signup or upgrade; you can cancel auto-renewal at any time from Settings, and cancellation takes effect at the end of the current billing period. Applicable taxes are your responsibility. If a feature you use becomes paid, we will give you reasonable advance notice and the choice to subscribe or stop using it.
Some AI features are metered using credits. Credits are consumed when you run an AI feature and do not carry a guaranteed accuracy or outcome; see Section 9 for our AI disclaimers. We will disclose current credit pricing and any expiration terms where credits are offered, and we do not currently offer refunds for consumed credits except as required by law.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Wiebelhaus Enterprises LLC and its licensors and is protected by intellectual property laws. Except for your content, no rights are granted to you other than the right to use the Service under these Terms.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Analytics, AI outputs, and financial views are informational only and are not professional, financial, or legal advice; verify important numbers before relying on them.
10. Limitation of liability
To the maximum extent permitted by law, Wiebelhaus Enterprises LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amounts you paid us for the Service in the 12 months before the claim arose.
11. Indemnification
You will indemnify and hold harmless Wiebelhaus Enterprises LLC from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially violate these Terms, if required by law, or if we discontinue the Service, in which case we will give reasonable notice where practicable. Sections 3 and 8 through 14 survive termination.
13. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes, we will notify you by email or an in-app notice before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
